内容提要: 依据法治原则,任何公权力的行为都应当接受合宪性和合法性的审查,从各国的实践看,这种审查主要由司法机关或者类似于司法机关地位的特设机关进行。但受各国政治理念、政治体制、司法机关地位等因素的制约,司法机关并不一定能够对所有的公权力行为进行司法审查。我国目前正处于司法改革过程之中,司法机关对公权力进行审查必然是司法改革的一大热点。简而言之,我国的司法机关不具备对公权力进行合宪性审查的基本条件,但完全具备对公权力的合法性进行审查的基本条件。
“司法审查”这一概念,近些年来成为我国法学界所普遍接受的概念和学术术语。在我国的语境中和政治体制下,并不存在司法审查这一学术概念,这一概念显然是“舶来品”①。关于我国的司法审查制度,我国学者除撰写了不计其数的论文外,已经出版了两本学术著作,一本是罗豪才教授主编的《中国司法审查制度》,一本是傅思明教授独著的《中国司法审查制度》。前一本书因是我国第一本关于司法审查的著作,且因是由罗豪才教授所主编,因此,对于这一概念在我国的普及影响甚巨。本文拟对司法审查的基本含义及我国司法审查的空间作一个探析。
一、何谓司法审查
关于“司法审查”这一概念,西方学者已作过比较多的论述,尤其以美国学者的论述居多。如美国学者盖尔霍恩·利文认为:“法院对机关行动或不行动的审查构成对行政行为的一套重要控制。司法审查与政治控制不同——而司法审查则系统规律地为那些因具体的机关决定而遭受损害的个人提供救济——司法审查试图通过要求有关机关提出能起支持作用的事实及合理的解释,来促进合乎情理的决策。”[1]
近年来,我国学者也在一个更广泛的意义上使用这一概念,特别是行政法学界的学者们使用这一概念最多,并认为,中国也存在司法审查。
有学者认为,司法审查系指司法机关运用司法审判权对政府行政行为的合法性进行审查的一种法律制度。而在澳大利亚,司法审查可分为两类,一类是普通法上的司法审查,另一类是制定法上的司法审查。前者是指普通法院根据普通法所拥有的司法审查权,它们根据普通法的一般原则对政府行政行为进行审查;后者是指普通法院不是根据普通法,而是依据特别司法审查法,即1977年行政决定(司法审查)法,对政府行政行为所作的审查[2]。还有学者认为, 司法审查是指法院应行政相对人的申请,审查行政机构行为的合法性,并作出相应裁决的活动[3]。
有学者认为,司法审查是国家通过司法机关对其他国家机关行使国家权力的活动进行审查,对违法活动通过司法活动予以纠正,并对由此给公民、法人权益造成的损害给予相应的补救的法律制度。并认为,1998年4 月通过的《中华人民共和国行政诉讼法》(以下简称《行政诉讼法》)建立了我国系统、完整的司法审查制度[4]。
有学者认为,我国的司法审查可以表述为:人民法院依法对具体行政行为的合法性进行审查的国家司法活动[4]。
由上可见,我国行政法学者通常将行政诉讼等同于司法审查,因为我国存在行政诉讼制度,因而得出结论,我国也存在司法审查。
“司法审查”是英美法系国家特有的一个概念和一项制度。在英美法系国家,不承认公法与私法的划分,即公权力的行使与私权利的行使都由普通司法机关进行判断。而在大陆法系国家,存在公法与私法的划分,认为公权力的行使存在一定的特殊性,普通司法机关不得对公权力的行使进行判断。这一点在作为大陆法系国家典型代表的法国最为明显。1790年8月16日至24日国民议会经过辩论作出的一项决议规定:“法院不得直接或者间接地参加立法权的行使,也不得妨害或者停止立法机关决议的执行。”(第二篇第10条)“法院不得制定规范,遇有解释法律或者制定新法之必要时,应向立法机关提出。”(第二篇第12条)可见,在法国禁止法院参与立法权的行使或者与立法行为发生关系。这一基本精神在以后的立法中得到了明确确认,以1791年宪法为开端,以后的宪法和有关法律对此都作了明确的规定②。后在法国的刑法中,将此作了更明确的规定:法官若干预立法权和行政权的行使,以渎职罪论处。正是在这一背景之下,法国在不得已的情形之下,成立了专门的独立于普通司法系统的行政法院,由行政法院审理行政案件,判断行政行为的合法性;成立了专门的宪法委员会,对立法行为的合宪性进行判断。其他大陆法系国家,与法国相同,也成立专门的行政法院审理行政案件;成立专门的宪法法院审理宪法争议。大陆法系国家的普通司法机关只审理普通的法律案件。
英美法系国家则与大陆法系国家不同。英美法系之下,法院的地位非常崇高,法官也具有无比的尊严,法官对所有的在案件审理过程中所要适用之“法”都具有解释权,包括宪法和法律。法院对宪法和法律的解释权属于司法权的范畴,并不需要宪法的另行授权。因此,普通司法机关对公权力的行使具有判断的可能性和基本条件。
司法审查之“司法”是指普通的行使司法权的司法机关,而不包括特设的类似于司法机关进行活动的专门机关;司法审查之“审查”仅指对公权力的审查,而不包括对公权力以外的私权利的审查。简言之,所谓司法审查是指由普通司法机关对公权力的行使所进行的审查。由于公权力行使的主体主要是立法机关和行政机关,就权力的内容而言,公权力主要是立法权和行政权,具体而言,司法审查包括对立法权行使的审查和对行政权行使的审查。就对立法权的司法审查而言,它是对立法权行使的合宪性进行的审查;就对行政权的司法审查而言,它是对行政权行使的合宪性和合法性进行的审查。
宪法意义上的司法审查,包括由普通司法机关对立法权行使的合宪性审查和对行政权行使的合宪性审查。行政法意义上的司法审查,是指普通司法机关对行政权行使的合法性审查,包括对抽象行政行为的合法性审查和对具体行政行为的合法性审查。一般意义上的司法审查是仅就宪法意义上而论的。
根据《行政诉讼法》第五条关于“人民法院审理行政案件,对具体行政行为是否合法进行审查”,第五十三条第一款关于“人民法院审理行政案件,参照国务院部、委根据法律和国务院的行政法规、决定、命令制定、发布的规章以及省、自治区、直辖市和省、自治区的人民政府所在地的市和经国务院批准的较大的市的人民政府根据法律和国务院的行政法规制定、发布的规章”的规定,以及最高人民法院关于《行政诉讼法司法》解释第六十二条第二款关于“人民法院审理行政案件,可以在裁判文书中引用合法有效的规章及其他规范性文件”的规定,我国存在行政法意义上的司法审查。

1. Short title.
Ordinance may be cited as the Pyramid Selling Prohibition
Ordinance.
2. Interpretation.

4. Liability of directors, partners etc.
Where an offence under this Ordinance has been committed by a
