福建省人民代表大会常务委员会关于修改《福建省实施〈中华人民共和国渔业法〉办法》的决定

(2002年3月28日福建省第九届人民代表大会常务委员会第三十一次会议通过)

  福建省第九届人民代表大会常务委员会第三十一次会议根据福建省人民政府提请审议《福建省实施〈中华人民共和国渔业法〉办法修正案(草案)》的议案,经审议,决定对《福建省实施〈中华人民共和国渔业法〉办法》作如下修改:

  一、删除第二十五条。
  二、条款顺序作相应调整。

  本决定自公布之日起施行。

  《福建省实施〈中华人民共和国渔业法〉办法》根据本决定作相应修正后,重新公布。


福建省实施《中华人民共和国渔业法》办法

(1989年3月10日福建省第七届人民代表大会常务委员会第七次会议通过,根据1993年3月7日福建省第八届人民代表大会常务委员会第二次会议《福建省人民代表大会常务委员会关于修改〈福建省实施中华人民共和国渔业法〉办法〉的决定》第一次修正,根据1997年10月25日福建省第八届人民代表大会常务委员会第三十五次会议《福建省人民代表大会常务委员会关于修改〈福建省实施〈中华人民共和国渔业法〉办法〉的决定》第二次修正,根据2002年3月28日福建省第九届人民代表大会常务委员会第三十一次会议《福建省人民代表大会常务委员会关于修改〈福建省实施〈中华人民共和国渔业法〉办法〉的决定》第三次修正)

第一章 总  则

  第一条 根据《中华人民共和国渔业法》和《中华人民共和国渔业法实施细则》的规定,结合我省实际情况,制定本办法。

  第二条 在我省管辖的水域从事养殖和捕捞水生动物、水生植物等渔业生产、经营活动以及渔业资源繁殖保护活动的单位和个人,必须遵守本办法。

  第三条 县以上人民政府渔业行政主管部门主管本行政区域内的渔业工作,负责《中华人民共和国渔业法》、《中华人民共和国渔业法实施细则》及本办法的组
织实施和监督检查。

  县以上渔业行政主管部门应设置渔政监督管理机构(以下简称渔政机构),并根据需要,在重要渔业水域、渔港和重点渔业乡(镇)设立渔政派出机构或配备专职渔政检查人员,依法执行渔政监督管理任务。

  省、市(地)渔业行政主管部门可以在重点渔港设置渔港监督机构,根据需要可以在其它渔港设置派出机构,依法执行渔港监督任务。

  上级渔政渔港监督管理机构可以对下级渔政渔港监督管理方面的重大问题进行协调和处理。

  各级渔政渔港监督管理机构应配备必要的检查船艇、车辆和通讯、监测等设备器材。

  第四条 渔政机构的主要职责是:

  (一)监督检查渔业法律、法规的执行;

  (二)保护、增殖渔业资源、征收渔业资源增殖保护费;

  (三)受渔业行政主管部门委托发放、注销渔业捕捞许可证和特许品种的生产、收购、运输许可证。

  (四)维护渔业生产秩序,协助有关部门处理渔业生产纠纷;

  (五)调查处理水污染造成渔业资源损失的事件;

  (六)对从事捕捞、养殖、购销等各种渔业活动,及其渔业证件、渔船、渔具、捕捞方法、渔获物等进行检查;

  (七)承办各级人民政府和渔业行政主管部门交办的其他渔政管理事项。

  渔政检查人员经省渔业行政主管部门考核合格发给渔政检查员证件。渔政检查人员在执行公务时必须出示检查证件。

  第五条 渔港监督机构的主要职责是:

  (一)监督检查同渔港监督有关的法律、法规的执行;

  (二)办理渔业船舶注册登记,船员考试发证,船舶进出港签证,检查渔业船舶、船员的证书、证件;

  (三)调查处理渔业船舶的海损事故;

  (四)监督管理渔业港口及其设施的使用、维护和建设;

  (五)监督管理渔港水域的交通安全秩序;

  (六)征收渔港建设基金;

  (七)保护渔港环境,监督船舶排污,调查处理船舶污染渔港事件,并协同环境保护部门调查处理陆源造成渔港污染的事件。

  第六条 公安、边防、海监、交通、环保、土地、水利、工商行政管理等部门,应当结合各自的职责,密切配合渔政渔港监督管理部门监督检查渔业法律、法规的执行。

  公安部门可以在重点渔业水域和渔区设置派出机构。

  群众性护渔组织应当在当地县级以上人民政府渔业行政主管部门及其渔政机构的业务指导下,依法开展护渔管理工作。

  第七条 外国人、外国渔业船舶进入我省管辖的渔业水域从事渔业生产或者渔业资源调查等活动,必须经国务院有关主管部门批准,接受渔政机构监督管理。进
入渔港的,按国务院有关规定执行。

  第八条 渔业的监督管理实行统一领导,分级管理。

  “机动渔船底拖网禁渔区线”内侧海域及国家指定由我省管辖的海域,由省渔业行政
主管部门及其所属的渔政机构监督管理;

  浅海、滩涂及江河、湖泊等水域的渔业,由行政区域内的有关市(地)、县(市、区)渔业行政主管部门及其所属的渔政机构监督管理;

  跨行政区域的,由有关县级以上人民政府协商制定管理办法,或由上一级渔业行政主管部门及其所属的渔政机构监督管理。

  第九条 渔业人员应当遵守海上交通安全法规,维护水上交通秩序,严禁在航道从事捕捞和养殖生产。

  第十条 在增殖和保护渔业资源,发展渔业生产,进行渔业科学技术研究、推广,渔业教育和执行渔业法规方面成绩显著的单位和个人,由各级人民政府给予精
神的或者物质的奖励。

第二章 养殖业

  第十一条 使用全民所有的水面、滩涂从事养殖生产的,必须经县级以上渔业行政主管部门同意,向同级土地管理部门提出申请,经土地管理部门审查,报县级
以上人民政府批准,发给土地使用证和养殖使用证。

  领有养殖使用证的单位和个人,在养殖经营期间,其养殖水体、设施、产品等受法律保护,任何单位和个人不得侵犯。

  第十二条 使用全民所有的水面、滩涂从事养殖生产的单位和个人,无正当理由不得使水面、滩涂荒芜(即放养量低于当地同类养殖水域平均放养量的60%),荒
芜满一年的,限于一年内开发利用,逾期仍未开发利用的,由发证机关吊销其土地使用证和养殖使用证。

  第十三条 有关水面、滩涂所有权和使用权的争议,依照《中华人民共和国土地管理法》第十三条处理,在争议解决前,任何一方均不得挑起事端,破坏养殖生
产。

  第十四条 国家建设征用集体所有的养殖水面、滩涂,或使用已确定养殖使用权的国家所有的水面、滩涂,按照《福建省土地管理实施办法》有关规定办理。

第三章 捕捞业

  第十五条 经国务院渔业行政主管部门批准从事外海和远洋捕捞业的,政府应当给予鼓励和扶持。具体办法由省人民政府另行制定。

  第十六条 严格控制近海渔船盲目发展。凡制造、更新改造、购置、进口从事捕捞业的渔船,必须经渔业行政主管部门批准。

  造船部门必须根据渔业行政主管部门的批准文件承造渔船。

  禁止将淘汰、报废的渔船继续用于捕捞作业。

  第十七条 拥有渔业船舶的单位和个人必须向渔港监督机构申请船舶登记,经渔船检验部门检验合格,领取船舶检验证书,办理航行签证簿后方可航行。

  第十八条 凡从事捕捞业的单位和个人,都必须向当地渔业行政主管部门申请领取捕捞许可证,按捕捞许可证规定的作业类型、场所、时限和渔具数量作业。未
取得捕捞许可证的,不得从事捕捞作业。

  中外合资、中外合作经营的渔业企业,未经省渔业行政主管部门转报国家有关主管部门批准,不得从事近海捕捞业。

  第十九条 批准发放捕捞许可证,不得突破省下达的船网工具控制指标。

  捕捞许可证审批权限:

  (一)从事外海、远洋捕捞业和从事近海捕捞的大型拖网、围网作业,经省渔业行政主管部门审核后,转报国家渔业行政主管部门批准;

  (二)从事近海捕捞作业的其他拖网及定置网、机大围缯作业,由省渔业行政主管部门批准;

  (三)钓、灯光围网、流刺网、小型围缯作业和桁杆虾拖网作业,由所在市(地)渔业行政主管部门批准;

  (四)内陆水域的捕捞许可证,县境内的,由县级渔业行政主管部门批准;跨市(地)、县(市、区)的由上一级渔业行政主管部门批准;

  (五)科学研究和教学实习等需要的,由省渔业行政主管部门批准。

  第二十条 严格控制采捕有重要经济价值的水生动物苗种、亲体。确实需要采捕中国对虾、长毛对虾、日本对虾亲体和鳗鲡、真鲷、石斑鱼、鲈鱼、中华绒螯蟹
等苗种的,应向所在县级渔业行政主管部门申请,经市(地)渔业行政主管部门审核,报省渔业行政主管部门核发专项捕捞许可证、收购许可证和准运证。

  娱乐性游钓和在尚未确定养殖使用权的滩涂采集水产品的,由县级人民政府制定管理办法。

第四章 渔业资源的增殖和保护

  第二十一条 各级人民政府及其渔业行政主管部门对其所辖渔业水域,应当统一规划,采取有效措施,保护和增殖渔业资源。

  第二十二条 本省重点保护的渔业资源品种和最低可捕标准以及最小网目尺寸,除国家规定外,由省人民政府渔业行政主管部门另行制定。

  市(地)、县(市、区)人民政府可根据本地资源状况,增加重点保护品种或提高最低可捕标准。

  第二十三条 从事捕捞作业的单位和个人,应该依法保护渔业资源。

  各种捕捞作业应当主动避让幼鱼群。捕捞的渔获物中,幼鱼体总量不得超过同种渔获物的25%。

  禁止采捕国家和省规定的珍贵水生动物,因科学研究需要采捕的,依照《中华人民共和国野生动物保护法》第十六条规定办理。

  第二十四条 进行人工放流、增殖水生动物、水生植物的内陆水域,由有关市(地)、县(市、区)人民政府制定管理办法,跨市(地)、县(市、区)水域的管理办法,由上一级人民政府制定。

  第二十五条 本省的禁渔区、禁渔期为:

  (一)机动底拖网作业

   机动底拖网作业禁渔区为以下六点联线内侧海域:

  第一点北纬27°10′ 东经121°10′
  第二点北纬26°05′ 东经120°40′
  第三点北纬25°18′ 东经120°05′
  第四点北纬24°52′ 东经119°38′
  第五点北纬24°00′ 东经118°30′
  第六点北纬23°10′ 东经117°40′

 机动底拖网作业的休渔期,按照国家和省的有关规定执行。

  (二)定置网作业

  1、40米等深线以外海域为定置网作业的禁渔区。

  2、40米等深线内侧海域定置网作业的禁渔期:

 闽浙交界至北茭之间海域为5月16日至7月15日,北茭至围头之间海域为5月1日至6月30日。上述海域内的局部港湾如有小型成熟鱼、虾类汛期,经济幼鱼幼体总重量不超过总渔获量的258%时,经市(地)渔业行政主管部门审查后,报省渔业行政主管部门批准,方可限量挂网生产。

  (三)机围缯作业

  1、4月1日至4月30日禁止进入闽南渔场北纬23°30′至24°00′、东经117°20′至118°10′范围内海域和闽中渔场北纬25°25′至26°00′、东经120°05'以西海域;

  2、5月1日至5月31日禁止进入闽东渔场北纬26°00′至26°40′、东经120°30′以西海域;

  3、闽东、闽中渔场大黄鱼冬汛期,闽南渔场大黄鱼春汛期,机围缯投产船数按国家和省确定的限额分配。

  (四)官井洋的禁渔区、禁渔期按《官井洋大黄鱼繁殖保护区管理规定》执行。

  (五)亲虾禁捕期,由省人民政府渔业行政主管部门另行制定。

  (六)内陆水域的禁渔区、禁渔期,由行政区域内的县级以上人民政府制定。

  第二十六条 渔业资源增殖保护费的征收使用办法,由省人民政府根据国家有关主管部门联合发布的《渔业资源增殖保护费征收使用办法》另行制定。

  第二十七条 禁止炸鱼、毒鱼,禁止使用电力、鸬鹚、鱼簖、目鱼笼捕鱼和敲舟古作业。在特定水域确有必要使用电力或鸬鹚捕鱼的,必须报经省渔业行政主管部门批准。

  禁止编织、制造和出售不符合规定的渔网、渔具。

  第二十八条 任何单位和个人不得向渔业水域排放有害渔业资源的污染物和废弃物。对排放废水、废渣致使渔业水体达不到《渔业水质标准》或《海水水质标准
》第一类要求的单位和个人,渔业行政主管部门应当协同环境保护部门提请当地人民政府责令其限期治理。逾期仍达不到要求的,由所在县级以上人民政府责令其停产。

  第二十九条 重点渔业港湾、渔场、苗种基地、养殖区和珍贵水生动物、水生植物保护区,不得从事拆船等污染渔业水域的行业。已建成的拆船等污染渔业水域的行业,各级人民政府应责令其限期治理,逾期仍达不到要求的,应当限期停产或搬迁。

  第三十条 在鱼、虾、蟹洄游通道建闸、筑坝,对渔业资源有严重影响的,建设单位应当建造过鱼设施或者采取其他补救措施,其设计任务书、设计文件和施
工方案,必须取得县级以上渔业行政主管部门同意。

  第三十一条 海滩围垦、海港工程和对渔业资源有影响的矿山开采,有关主管部门在审批项目时,应当征求同级渔业行政主管部门意见。

  重要的苗种基地和养殖场所,不得围垦。

第五章 罚  则

  第三十二条 违反禁渔区、禁渔期规定进行捕捞的,擅自捕捞国家及本省规定禁止捕捞的珍贵水生动物的,没收其渔获物和违法所得,处以罚款;并可以没收渔
具,吊销捕捞许可证。罚款按下列规定执行:

  (一)内陆水域机动渔船处一百元至五千元罚款;非机动渔船处五十元至三千元罚款;

  (二)海洋机动渔船每作业单位处八百元至五万元罚款;

  1.442千瓦(600马力)以上的渔船,处三千元至五万元罚款;

  2.184千瓦(250马力)以上未满442千瓦的渔船,处二千元至二万元罚款;

  3.59千瓦(80马力)以上未满184千瓦的渔船,处一千元至一万元罚款;

  4.未满59千瓦的渔船,处八百元至三千元罚款。

  (三)海洋非机动渔船,每作业单位处五百元至二千元罚款。

  (四)定置作业,每张网处一百元至一千元罚款。

  (五)擅自捕捞珍贵水生动物的,在内陆水域处五十元至五千元罚款;在海洋处五百元至五万元罚款。

  (六)采捕鳗鲡苗的,每张网具处一百元至五百元罚款。

  第三十三条 未取得捕捞许可证擅自进行捕捞的,或伪造捕捞许可证进行捕捞的,没收渔获物和违法所得,可以并处罚款;情节严重的,可以没收渔具。罚款按
下列规定执行:

  (一)内陆机动渔船,每作业单位处一百元至五百元罚款;非机动渔船,每作业单位处五十元至一百五十元罚款。

  (二)海洋机动渔船,每作业单位处二百元至二万元罚款。

  1.442千瓦(600马力)以上的渔船,处三千元至二万元罚款;

  2.184千瓦(250马力)以上未满442千瓦的渔船,处二千元至一万五千元罚款;

  3.59千瓦(80马力)以上未满184千瓦的渔船,处一千元至一万元罚款;

  4.未满59千瓦(80马力)的渔船,处二百元至五千元罚款。

  (三)非机动渔船,每作业单位处一百元至五百元罚款。

  第三十四条 使用禁用的渔具、捕捞方法进行捕捞的,没收渔获物和违法所得,处以罚款,还可以没收渔具和其他作案工具,吊销捕捞许可证。罚款按下列规定执行:

  (一)炸鱼、毒鱼,在内陆水域处五十元至五千元罚款;在海洋处一千元至五万元罚款。

  (二)敲舟古作业的,处一千元至五万元罚款。

  (三)未经批准使用鸬鹚、鱼簖、目鱼笼捕鱼的,处五十元至二百元罚款。

  (四)未经批准使用电力捕鱼的,在内陆水域处二百元至一千元罚款,在海洋处五百元至三千元罚款。

  (五)使用小于规定的最小网目尺寸的网具进行捕捞的,处五十元至一千元罚款。

  第三十五条 违反捕捞许可证关于作业类型、场所、时限和渔具数量规定进行捕捞的,没收渔获物和违法所得,可以并处罚款;情节严重的,可以没收其渔具,
吊销捕捞许可证。罚款按下列规定执行:

  (一)内陆渔业非机动渔船,处二十五元至五十元罚款;

  (二)内陆渔业机动渔船和海洋渔业非机动渔船,处五十元至一百元罚款;

  (三)海洋渔业机动渔船,处五十元至三千元罚款;

  (四)外海渔船擅自进入近海捕捞的,除罚款三千元至二万元外,并征收渔业资源增殖保护费。

  第三十六条 依本章第三十三、三十四、三十五、三十六条规定需处以罚款的,还可以对其船长或者单位负责人另处一百元至五百元罚款。

  第三十七条 违反本办法第九条规定的,由渔政渔港机构责令其拆除障碍物,逾期不执行的,由渔政渔港机构协同港航管理部门强行拆除,并没收其障碍物。违
反本办法第十六条第一款规定的,对船主按船价的15%处以罚款;违反第十六条第二款规定的,对承造渔船者按10%处以罚款;违反第十六条第三款规定的,没收渔获物、渔具,处一万元至五万元罚款,并封存其渔船,限期拆毁。拆毁渔船办法由人民政府另行规定。

  违反本办法第十七条规定的,限期改正,并处五百元至二千元罚款。

  违反本办法第二十八条第二款规定的,除没收其网具和非法所得外,可以并处该网具价值的一至二倍罚款。

  违反办法第二十三条第二款规定的,没收超比例部分的幼鱼体,并按每超1公斤幼鱼体处一元至五元罚款。

  第三十八条 违反本办法第二十九、三十、三十二条规定,造成渔业资源损失的,应当给予赔偿。赔偿费按水生动物、水生植物死亡量的0.5倍至3倍计算。

  违反本办法第三十一条规定对渔业资源有严重影响的,应当给予赔偿。

  赔偿费用于增殖、保护渔业资源或赔偿受到经济损失的单位和个人。

  第三十九条 本办法规定的行政处罚权,由渔业行政主管部门及其所属的渔政渔港监督管理机构行使。但吊销捕捞许可证的处罚,由原发证机关决定。

  第四十条 进行行政处罚,应当填写处罚决定书,处以罚款和没收、渔具、渔获物、作案工具以及违法所得的,应当开具凭证,并在捕捞许可证上载明。

  第四十一条 当事人对渔业行政主管部门作出的行政处罚决定不服的,可以在接到处罚决定书之日起十五日内,向上一级渔业行政主管部门申请复议,对渔政渔
港机构的处罚决定不服的,可以向直接主管该机构的渔业行政主管部门申请复议;也可以在接到处罚决定书之日起三十日内,向人民法院提出起诉。期满不起诉又不履行的,由作出处罚决定的机关申请人民法院强制执行。

  在海上作业的,必须先执行处罚决定,拒不执行的,执法人员有权扣留捕捞许可证或渔具、渔船。

  第四十二条 有下列行为之一的,由公安机关依照《中华人民共和国治安管理处罚条例》的规定处罚;构成犯罪的,由司法机关依法追究刑事责任:

  (一)拒绝、阻碍渔政渔港检查监督人员依法执行公务的;

  (二)偷窃、哄抢或者破坏渔具、渔船、渔获物的。

  第四十三条 本办法颁布实施后,超过省规定的船网工具控制指标发放捕捞许可证或超越职权发放捕捞许可证的,上级渔业行政主管部门应当对直接责任人员及
其主管人员进行行政处分。

  第四十四条 渔政渔港检查监督人员在执行公务中玩忽职守或者徇私枉法的,由其所在单位或者上一级主管部门给予行政处分;构成犯罪的,依法追究刑事责任。

第六章 附  则

  第四十五条 本办法应用解释权属省渔业行政主管部门。

  第四十六条 本办法自颁布之日起施行。

各县(市、区)人民政府,市政府各部门、直属各单位:
《嘉兴市体育局职能配置、内设机构和人员编制规定》已经市政府同意,现予印发,请认真贯彻执行。

嘉兴市体育局职能配置内设机构和人员编制规定

根据《中共浙江省委办公厅 浙江省人民政府办公厅关于印发〈嘉兴市深化完善政府机构改革方案〉的通知》(浙委办〔2004〕 79号),设置嘉兴市体育局。市体育局是主管体育工作的市政府直属机构。
一、主要职责
(一)贯彻执行国家、省关于体育工作的方针、政策;根据本市实际,研究起草体育行政管理的实施意见,经审议通过后组织实施。
(二)研究、指导和推动体育体制改革,制定体育发展战略,编制体育事业的中长期发展规划,协调区域性体育发展。
(三)组织实施《全民健身计划纲要》,负责国民体质监测,指导开展群众性体育活动。
(四)统筹规划竞技体育发展工作,加强体育后备人才培训工作的宏观管理和指导;负责重大体育竞赛工作的规划、领导和组织协调;组织开展反兴奋剂工作。
(五)培育、发展体育产业;负责体育市场的综合管理,有关体育市场行政许可应听取有关行政机关的意见,其执法工作委托市文化市场行政执法支队承担;协同有关部门制定、组织实施全市体育事业基本建设规划。
(六)组织和指导体育宣传、科学研究和教育工作,培育体育干部和专业人才,加强体育队伍的思想政治工作。
(七)管理体育外事工作,开展国际间以及与香港、澳门特别行政区和台湾地区的体育合作与交流。
(八)管理直属事业单位;负责全市体育社团的资格审查;依法管理健身气功;联系指导市体育科学学会的有关工作。
(九)承办市政府交办的其他事项。
二、内设机构
根据上述职责,市体育局设3个职能处室:
(一)办公室(体育产业处)
协助局领导搞好机关综合协调;负责草拟审核有关体育行政管理的重要文稿,研究制定全市体育事业中长期发展规划、体育产业发展规划及政策;负责局重大工作事项的督查;协调办理人大代表建议、政协委员提案;会同有关部门管理全市体育职称评审、体育外事工作;负责局属机关事业单位的组织、人事、宣传、老干部、统战、信访、保密、计划生育、安全保卫、综合治理、财务、统计、档案等党政事务工作;协同有关部门规划、制定体育基本建设规划,管理市级体育基本建设工作;负责体育市场的综合管理工作。
(二)训练竞赛处
研究拟定全市竞技体育发展规划和全市业余训练的项目设置、重点布局及后备人才选拔培养方案;负责制订全市竞赛计划和制度,组织管理和协调全市综合性运动会、中小学体育竞赛及参加省以上各体育项目竞赛;负责教练员的培训、考核和裁判员管理、培训、考核及二级裁判员审批;负责全市运动员技术等级核准和审核;负责全市体育运动项目纪录的审核公布;研究拟订全市体育科研、教育和反兴奋剂工作的相关政策和制度;组织、指导全市体育科研学术交流、科技服务工作;联系指导市体育科学学会工作;配合省兴奋剂检查工作。
(三)群众体育处
研究和制定全市群众体育工作的发展规划和有关制度,规划和组织实施《全民健身计划纲要》和国民体质监测工作;负责全市社会体育指导员等级的核准和审核,指导、协调和推动学校、农村、城市及社会各类人群的体育活动;负责指导、管理群众体育单项协会工作;组织协调传统项目学校及社会各类人群的单项竞赛,并组织参加省以上各体育项目竞赛活动,普及推广《普通人群锻炼标准》,规划实施全民健身工程;对社会健身气功进行业务管理。
三、人员编制
市体育局行政编制10名(含纪检、监察和后勤服务人员编制)。其中局长1名,副局长2名,科级领导职数4名。
纪检、监察机构的设置和领导职数,按有关文件规定执行。
四、其他事项

JOINT DECLARATION OF THE GOVERNMENT OF THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND AND THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF CHINA ON THE QUESTION OF HONG KONG

  the Government of the People's Republic of China have reviewed 
with
  sfaction the friendly relations existing between the two 
Governments
  peoples in recent years and agreed that a proper negotiated
settlement
  he question of Hong Kong, which is left over from the past, is 
con-
  ve to the maintenance of the prosperity and stability of Hong Kong
and
  he further strengthening and development of the relations between 
the
  countries on a new basis. To this end, they have, after talks 
between
  delegations of the two Governments, agreed to declare as follows:
  
  he Government of the People's Republic of China declares 
that to
  ver the Hong Kong area (including Hong Kong Island, Kowloon and 
the
  Territories, hereinafter referred to as Hong Kong) is the 
common
  ration of the entire Chinese people, and that it has decided to
resume
  exercise of sovereignty over Hong Kong with effect from 1 July
1997.
  
  he Government of the United Kingdom declares that it will restore
Hong
  to the People's Republic of China with effect from 1 July 1997.
  
  he Government of the People's Republic of China declares 
that the
  c policies of the People's Republic of China regarding Hong Kong 
are
  ollows:
  Upholding national unity and territorial integrity and taking 
account
  he history of Hong Kong and its realities, the People's 
Republic of
  a has decided to establish, in accordance with the 
provisions of
  cle 31 of the Constitution of the People's Republic of China, a 
Hong
  Special Administrative Region upon resuming the 
exercise  of
  reignty over Hong Kong.
  The Hong Kong Special Administrative Region will be directly
under the
  ority of the Central People's Government of the People's 
Republic of
  a. The Hong Kong Special Administrative Region will enjoy 
a high
  ee of autonomy, except in foreign and defence affairs which are 
the
  onsibilities of the Central People's Government.
  The Hong Kong Special Administrative Region will be 
vested with
  utive, legislative and independent judicial power, including 
that of
  l adjudication. The laws currently in force in Hong Kong will 
remain
  cally unchanged.
  The Government of the Hong Kong Special Administrative Region
will be
  osed of local inhabitants. The chief executive will be 
appointed by
  Central People's Government on the basis of the results of 
elections
  onsultations to be held locally. Principal officials will be
nominated
  he chief executive of the Hong Kong Special Administrative Region 
for
  intment by the Central People's Government. Chinese and 
foreign
  onals previously working in the public and police services 
in the
  rnment departments of Hong Kong may remain in employment. British 
and
  r foreign nationals may also be employed to serve as advisers or 
hold
  ain public posts in government departments of the Hong Kong 
Special
  nistrative Region.
  The current social and economic systems in Hong Kong will 
remain
  anged, and so will the life-style. Rights and freedoms, 
including
  e of the person, of speech, of the press, of assembly, of
association,
  ravel, of movement, of correspondence, of strike, of 
choice of
  pation, of academic research and of religious belief will be 
ensured
  aw in the Hong Kong Special Administrative Region. Private 
property,
  rship of enterprises, legitimate right of inheritance and 
foreign
  stment will be protected by law.
  The Hong Kong Special Administrative Region will retain the
status of
  ee port and a separate customs territory.
  The Hong Kong Special Administrative Region will retain the
status of
  nternational financial centre, and its markets for foreign 
exchange,
  , securities and futures will continue. There will be free 
flow of
  tal. The Hong Kong dollar will continue to circulate and remain
freely
  ertible.
  The Hong Kong Special Administrative Region will have 
independent
  nces. The Central People's Government will not levy taxes on the 
Hong
  Special Administrative Region.
  
  The Hong Kong Special Administrative Region may establish 
mutually
  ficial economic relations with the United Kingdom and other
countries,
  e economic interests in Hong Kong will be given due regard.
  Using the name of "Hong Kong, China", the Hong Kong 
Special
  nistrative Region may on its own maintain and develop 
economic and
  ural relations and conclude relevant agreements with states, 
regions
  relevant international organizations. The Government of the
Hong Kong
  ial Administrative Region may on its own issue travel 
documents for
  y into and exit from Hong Kong.
  The maintenance of public order in the  Hong  Kong 
Special
  nistrative Region will be the responsibility of the Government
of the
  Kong Special Administrative Region.
  The above-stated basic policies of the People's Republic of 
China
  rding Hong Kong and the elaboration of them in Annex I to this 
Joint
  aration will be stipulated, in a Basic Law of the Hong Kong 
Special
  nistrative Region of the People's Republic of China, by the 
National
  le's Congress of the People's Republic of China, and they will 
remain
  anged for 50 years.
  
  he Government of the United Kingdom and the Government of the
People's
  blic of China declare that, during the transitional period
between the
  of the entry into force of this Joint Declaration and 30 June 
1997,
  Government of the United Kingdom will be responsible 
for the
  nistration of Hong Kong with the object of maintaining and 
preserving
  economic prosperity and social stability; and that the 
Government of
  People's Republic of China will give its cooperation 
in this
  ection.
  
  he Government of the United Kingdom and the Government of the
People's
  blic of China declare that, in order to ensure a smooth 
transfer of
  rnment in 1997, and with a view to the effective 
implementation of
  Joint Declaration, a Sino-British Joint Liaison Group will be set 
up
  this Joint Declaration enters into force; and that it 
will be
  blished and will function in accordance with the provisions of 
Annex
  o this Joint Declaration.
  
  he Government of the United Kingdom and the Government of the
People's
  blic of China declare that land leases in Hong Kong and other 
related
  ers will be dealt with in accordance with the provisions of Annex 
III
  his Joint Declaration.
  
  he Government of the United Kingdom and the Government of the
People's
  blic of China agree to implement the preceding declarations 
and the
  xes to this Joint Declaration.
  
  his Joint Declaration is subject to ratification and shall enter 
into
  e on the date of the exchange of instruments of ratification, 
which
  l take place in Beijing before 30 June 1985. This Joint 
Declaration

 ANNEX I: ELABORATION BY THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF 
CHINA OF ITS BASIC POLICIES REGARDING HONG KONG
  
  Government of the People's Republic of China elaborates the 
basic
  cies of the People's Republic of China regarding Hong Kong as set 
out
  aragraph 3 of the Joint Declaration of the Government of the 
United
  dom of Great Britain and Northern Ireland and the Government of 
the
  le's Republic of China on the Question of Hong Kong as follows:
  
  
  Constitution of the People's Republic of China stipulates in 
Article
  hat "the state may establish special administrative 
regions when
  ssary. The systems to be instituted in special administrative 
regions
  l be prescribed by laws enacted by the National People's 
Congress in
  light of the specific conditions." In accordance with this 
Article,
  People's Republic of China shall, upon the resumption of the 
exercise
  overeignty over Hong Kong on 1 July 1997, establish the Hong 
Kong
  ial Administrative Region of the People's Republic of China.  
The
  onal People's Congress of the People's Republic of China shall 
enact
  promulgate a Basic Law of the Hong Kong Special Administrative 
Region
  he People's Republic of China (hereinafter referred to as the 
Basic
  in accordance with the Constitution of the People's 
Republic of
  a, stipulating that after the establishment of the Hong Kong 
Special
  nistrative Region the socialist system and socialist policies 
shall
  be practised in the Hong Kong Special Administrative Region and 
that
  Kong's previous capitalist system and life-style shall 
remain
  anged for 50 years.
  Hong Kong Special Administrative Region shall be directly 
under the
  ority of the Central People's Government of the People's 
Republic of
  a and shall enjoy a high degree of autonomy. Except for foreign 
and
  nce affairs which are the responsibilities of the Central 
People's
  rnment, the Hong Kong Special Administrative Region shall be 
vested
  executive, legislative and independent judicial power, including
that
  inal adjudication. The Central People's Government shall
authorise the
  Kong Special Administrative Region to conduct on its own 
those
  rnal affairs specified in Section XI of this Annex.

  ial Administrative Region acting in accordance with the
recommendation

  ic servants previously serving in Hong Kong in all 
government
  rtment, including the police department, and members of the 
judiciary
  all remain in employment and continue their service 
with pay,
  wances, benefits and conditions of service no less 
favourable than
  re. The Hong Kong Special Administrative Region government 
shall pay
  uch persons who retire or complete their contracts, as well 
as to
  e who have retired before 1 July 1997, or to their dependants, 
all
  ions, gratuities, allowances and benefits due to them on terms
no less
  urable than before, and irrespective of their nationality or
place of
  dence.
  Hong Kong Special Administrative Region Government may employ 
British
  other foreign nationals previously serving in the public 
service in
  Kong, and may recruit British and other foreign nationals 
holding
  anent identity cards of the Hong Kong Special Administrative
Region to
  e as public servants at all levels, except as heads 
of major
  rnment departments (corresponding to branches or 
departments at
  etary level) including the police department, and as deputy 
heads of
  of those departments. The Hong Kong Special Administrative 
Region
  rnment may also employ British and other foreign nationals as
advisers
  overnment departments and, when there is a need, may recruit
qualified
  idates from outside the Hong Kong Special Administrative 
Region to
  essional and technical posts in government departments, 
The above
  l be employed only in their individual capacities and, like 
other
  ic servants, shall be responsible to the  Hong  Kong 
Special
  nistrative Region Government.
